Use of the Site
By accessing or using bdgwinapp.com.co (the "Site"), you agree to be bound by these Terms of Service in their entirety. BDG Win reserves the right to amend these Terms at any time without prior notice; your continued use of the Site after any amendment is posted constitutes your acceptance of the revised Terms.
Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872. Access to the Site may be restricted in certain states or territories within India where applicable local regulations prohibit the relevant services. By accessing the Site, you represent and warrant that you meet all applicable eligibility requirements.
Permitted Use and Prohibited Conduct
You may use the Site solely for lawful, personal, non-commercial purposes. The following activities are strictly prohibited: attempting to bypass or breach Site security measures; using bots, scrapers, or automated tools to harvest data; uploading malicious code or malware; impersonating other users or BDG Win personnel; and engaging in any conduct that violates Indian law or infringes the rights of any third party. BDG Win may suspend or permanently terminate accounts found to be in breach of these Terms without prior notice or liability.
Intellectual Property
All content on the Site, including the BDG Win name, logo, graphics, text, software, audio-visual materials, and data compilations, is the exclusive property of BDG Win or its licensors. These materials are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian intellectual property statutes. Unauthorised use of any such materials is strictly prohibited.
Limited Licence
BDG Win grants you a limited, non-exclusive, non-transferable, and revocable licence to access and view the Site for personal, non-commercial use only. You may not reproduce, modify, adapt, distribute, publicly display, sell, or create derivative works from any Site content without prior written consent from BDG Win. Any proprietary notices, copyright legends, or trademark symbols must not be removed or altered.
User Content and Infringement Claims
By submitting any content to the Site, you grant BDG Win a royalty-free, perpetual, worldwide, irrevocable, and sublicensable licence to use, reproduce, modify, and distribute that content in connection with Site operations. You warrant that your submissions do not infringe any third-party intellectual property rights. If you believe material on the Site infringes your intellectual property, contact us in writing with full particulars of the alleged infringement; BDG Win will investigate and take appropriate action in accordance with applicable law.
Limitation of Liability
To the fullest extent permitted by applicable Indian law, BDG Win, its directors, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your access to or use of, or inability to use, the Site or its content.
No Warranty
The Site is provided on an "as is" and "as available" basis without representations or warranties of any kind, whether express or implied. BDG Win does not warrant that the Site will be continuously available, error-free, or free from viruses or other harmful components. Any reliance you place on information or materials found on the Site is entirely at your own risk, including any financial decisions made on the basis of such information.
Payment and Transaction Disclaimer
Where the Site facilitates or references transactions processed through third-party UPI-based payment platforms, including PhonePe, Google Pay (GPay), and BHIM, BDG Win accepts no liability for transaction failures, processing delays, declined payments, or disputes arising from those platforms. All payment-related queries and disputes must be raised directly with the relevant payment service provider in accordance with their own terms of service and applicable Reserve Bank of India guidelines and directives.
